Phood Community Farm Terms of Use

1. Conditions

By accessing this website and using the platform, accessible at https://phoodfarm.org and sub domain https://member.phoodfarm.org, you agree to be bound by these Terms of Use and agree that you are responsible for compliance with all applicable local laws. If you do not agree with any of these terms, you are unfortunately unable to visit this website and platform or contribute to the community. The material on this website is protected by copyright and trademark law.

2. Membership

As a member of the Phood Community Farm participating as a Community Farmer or Community Shopper (herein referred to as a Member), you agree to abide by the Terms of Use. Members can choose to participate as a Community Farmer or a Community Shopper. Community Farmers and shoppers can choose to become members by signing up at member.phoodfarm.org. Community Farmers commit to working and learning 6 hours per month on the local Phood land farm. In return, the Community Farmer receives a vegetable package at very favorable prices. Every week the participant collects his Phood Farm Box. Phood Farm undertakes to make the Phood Farm Box available on a day and time agreed with the member. The responsibility for collecting the Phood Farm Box lies with the member. Phood Farm is not obliged to re-prepare an uncollected Phood Farm Box.

Both participants will send payments via automatic recurring payments via SEPA Direct Debit or Credit Card direct debit, initiated from our payment processing provided by Stripe. By signing up as a member for the weekly recurring payments, participants agree to sign up for a minimum of 1 month before they can discontinue membership and weekly payments on a weekly basis. This is to guarantee the energy, time and costs of onboarding the member. Members who register annually choose this at their own discretion and are not entitled to a refund during this period. Members can upgrade or downgrade to different quantities or from ‘Farmer’ to ‘Shopper’ at any time. Canceling a membership can be done via the account in the platform at member.phoodfarm.org. Phood Farm will receive this directly. Phood Farm reserves the right to terminate a membership if there are valid reasons for this.

If Community Farmers are structurally unable to complete the hours, Community Farmers will be given the opportunity to switch as a Community Shopper. If this is not agreed to and therefore the conditions for Community Farming are not met, we reserve the right to terminate the membership. In proper consultation, input working time can be shifted to other times or arranged flexibly.

3. Promise of delivery

Phood Farm Foundation as Phood Community Farm promises to make every effort to deliver the value of the products listed on their website when signing up. However, if unforeseen environmental or external challenges arise for which Phood Farm is not equipped, it reserves the right to temporarily supply Phood Farm Boxes below the declared value. This will be rectified at a later stage or the value will be delivered in another way as compensation. Phood Farm will compensate the lost value in goods or products, immediately or at a later stage. When unforeseen challenges arise that cause delivery to be less than planned, this is well documented and corrected in a timely manner. In the event of potentially catastrophic events occurring that would limit Phood Farm Foundation’s ability to supply products, Phood Farm reserves the right to terminate membership on its own initiative and suspend payments.

4. Use license

Permission is granted to temporarily download one copy of the materials on Phood Farm Foundation’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

– Modify or copy the materials;
– Use the materials for commercial purposes or for public display;
– Attempt to reverse engineer software on the Phood Farm Foundation website;
– Remove any copyright or other proprietary notices from the materials; or
– Transmitting the materials to another person or “mirroring” the materials on any other server.

As a result, the Phood Farm Foundation may be terminated if any of these restrictions are violated. Upon termination, your viewing privileges will also terminate and you must destroy any downloaded materials in your possession whether in print or electronic format.

All materials on the Phood Farm Foundation website and platform are provided “as is”. Phood Farm Foundation makes no warranties, express or implied, and therefore disclaims all other warranties. 6. Restrictions

Stichting Phood Farm or its suppliers cannot be held liable for any damage incurred while working on the outside area or arising from the use or inability to use the materials on the Stichting Phood Farm website, even if Stichting Phood Farm or an authorized representative of this Website has been notified orally or in writing of the possibility of such damages. Some jurisdictions do not allow limitations on implied warranties or limitations of liability for incidental damages. These limitations may not apply to you.

11. One + One = Tree products

The “purchase” of a tree via https://phoodfarm.org/one-plus-one-is-tree/ at Phood Farm is symbolic and sponsoring in nature. This means that buyers do not become the actual owners of the tree. Instead, they contribute to their planting, conservation and care. Although the buyer is symbolically connected to the tree, there are no further rights associated with this connection.

Ownership and Care: Full responsibility for the maintenance and care of the tree rests with Phood Farm. Buyers acknowledge that they do not acquire any ownership rights to the tree upon purchase. It is not permitted to spend time near the tree at the location where it is planted without consultation.

Purchasing a tree through https://phoodfarm.org/one-plus-one-is-tree/ does not grant the purchaser any rights, claims or interests in the tree. Buyers cannot derive any rights from the ownership, use or disposition of the tree.

By “purchasing” a tree through https://phoodfarm.org/one-plus-one-is-tree/, the purchaser agrees to and fully accepts these terms.

12. Applicable law

Any claim relating to Phood Farm Foundation (Website) shall be governed by the laws of NL without regard to its conflict of law provisions.
